Waste Clearance Pimlico Terms and Conditions

These Terms and Conditions set out the basis on which Waste Clearance Pimlico provides waste collection and clearance services. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, business, landlord, managing agent or other organisation that requests or receives services from Waste Clearance Pimlico.

Company, we, us or our means Waste Clearance Pimlico, the waste collection and clearance service provider.

Services means any waste removal, waste collection, rubbish clearance, bulky item removal, recycling, or related work performed by the Company.

Waste means any household, commercial, garden, construction or other material that the Customer asks the Company to remove, subject to these Terms and Conditions and applicable waste regulations.

Booking means an agreed arrangement for the Company to provide Services at a specified property and time.

2. Scope of Services

The Company provides waste collection and clearance services for domestic and commercial customers. Services may include removal of general household waste, bulky items, light construction waste, garden waste and office waste, subject to applicable laws and disposal regulations.

The Company does not remove certain categories of hazardous or special waste, including but not limited to asbestos, medical waste, chemicals, solvents, oils, gas bottles, pressurised containers and other regulated materials that require specialist handling and licences. The Customer is responsible for informing the Company in advance if any waste may be hazardous or restricted.

The Company reserves the right to decline any job where the waste is unsuitable, unsafe to handle, not as described at the time of booking, or would breach any applicable waste regulation or health and safety requirement.

3. Booking Process

Bookings for waste clearance and waste collection services can be made by telephone or email. At the time of booking, the Customer will be asked to provide details including the property address, type and approximate volume of waste, access information and preferred dates and times.

Any quotation provided before the Company attends the property will normally be based on the Customer's description of the waste. All such quotations are indicative only and are subject to confirmation once the Company has inspected the waste on site. If the actual volume or nature of the waste is different from that described, the price may change.

A booking is considered confirmed only when the Company has accepted the booking and the Customer has accepted any applicable charges. The Company will use reasonable efforts to attend at the agreed time, but all arrival times are estimates. Time is not of the essence for the purposes of these Terms and Conditions, and the Company shall not be liable for minor delays caused by traffic, access issues or circumstances beyond its reasonable control.

4. Access and Customer Obligations

The Customer must ensure that the Company has safe, reasonable and lawful access to the property and the waste to be removed at the agreed time. This includes arranging for necessary keys, permits, parking arrangements and clear pathways to the waste.

The Customer is responsible for ensuring that the waste to be removed is clearly identified and segregated if necessary. The Customer must not include in the waste any items that are prohibited, hazardous or illegal to transport or dispose of, and must not conceal such items within other waste.

If access to the property or to the waste is obstructed, unsafe or not as described, the Company may, at its discretion, either cancel the booking or apply additional charges to cover wasted time, additional labour, parking, waiting, or additional journeys.

5. Pricing and Quotations

Prices for Services are based primarily on the type and volume of waste, the weight where applicable, the nature of items to be removed, the labour required and any disposal fees or regulatory charges. The Company may also take into account factors such as access difficulty and distance from the vehicle to the waste.

Any quotation given before the Company attends the property is an estimate only and is not binding. A final price will be confirmed on site once the waste has been assessed. If the Customer does not accept the revised price, the Company reserves the right to cancel the Service and may charge a call-out or attendance fee.

All prices are quoted in pounds sterling and will include or exclude VAT depending on the Company's tax status at the time of providing the quotation. Any applicable taxes will be clearly explained to the Customer.

6. Payments and Invoicing

Unless otherwise agreed in writing, payment is due immediately upon completion of the Service. The Company accepts common payment methods, which may include cash, debit or credit card, or bank transfer. The payment method must be agreed at or before the time of booking.

For commercial Customers or larger jobs, the Company may agree different payment terms, including partial payment in advance or payment on invoice. Where Services are provided on account, the Customer must pay all invoices in full by the due date specified on the invoice. If no date is specified, payment is due within 14 days of the invoice date.

If any payment becomes overdue, the Company reserves the right to charge interest and administrative fees in accordance with applicable UK legislation on late payments. The Company may also suspend or refuse further Services until all outstanding sums have been paid in full.

7. Cancellations and Rescheduling

The Customer may cancel or reschedule a booking by providing notice to the Company. To avoid cancellation charges, the Customer must give at least 24 hours' notice before the agreed arrival window. Cancellations or significant changes made with less than 24 hours' notice may incur a cancellation fee to cover the Company's costs, including staff time and travel planning.

If the Customer is not present at the property at the agreed time, or if the Company cannot gain access for reasons within the Customer's control, this may be treated as a late cancellation and a call-out fee may be charged.

The Company reserves the right to cancel or reschedule a booking at any time if it is unable to perform the Services safely or lawfully, including due to extreme weather, vehicle breakdown, accidents, staff illness, access problems, or discovery of prohibited or hazardous waste. In such cases, the Company will use reasonable efforts to contact the Customer and arrange a new appointment. Where the Company cancels due to its own fault and no work has been carried out, any prepayments will be refunded.

8. Customer Property and Site Condition

The Customer is responsible for ensuring that the property is in a condition that allows the Company to carry out its work safely. The Customer should remove or protect fragile items, valuables and personal belongings from areas where the Company will be working.

The Company will take reasonable care when performing the Services but will not be responsible for pre-existing damage, defects or wear and tear at the property. The Customer should notify the Company of any particular risks, such as unstable structures, loose floorboards or other hazards, before work begins.

9. Title to Waste and Disposal

Once the waste has been loaded onto the Company’s vehicle and full payment has been made for the Service, title to the waste passes from the Customer to the Company. The Company will then be responsible for transporting, processing and disposing of the waste in accordance with applicable laws and waste regulations.

The Customer warrants that they are the owner of the waste or have the authority of the owner to arrange for its removal. The Customer agrees to indemnify the Company against any claim by a third party that arises from the removal of waste without proper authority.

10. Compliance with Waste Regulations

The Company will carry and, where required, maintain appropriate licences, registrations and documentation to operate as a waste carrier and to dispose of waste at authorised facilities. All waste will be taken to suitable disposal or recycling sites that are licensed or permitted under UK environmental legislation.

Where legally required, the Company may issue or complete waste transfer notes or similar documentation when collecting waste. The Customer agrees to provide accurate information for these records and to retain any copies that the law requires them to keep.

The Customer must not request or permit the Company to dispose of waste unlawfully, such as by fly-tipping or using unauthorised sites. If the Customer requests any action that would breach waste regulations, the Company will refuse to comply and may terminate the Service immediately.

11. Liability and Limitations

Nothing in these Terms and Conditions excludes or limits the Company’s liability for death or personal injury caused by its negligence, for fraud, or for any other liability that cannot lawfully be limited or excluded under UK law.

Subject to the foregoing, the Company’s total liability arising from or in connection with the provision of Services, whether in contract, tort, negligence or otherwise, shall be limited to the price paid or payable by the Customer for the specific Service giving rise to the claim.

The Company shall not be liable for any indirect or consequential loss, including but not limited to loss of profit, loss of business, loss of opportunity, or loss of goodwill. The Company will not be responsible for delays or failure to perform caused by events beyond its reasonable control, such as extreme weather, traffic incidents, accidents, acts of government, strikes or other force majeure events.

The Customer must notify the Company in writing of any complaint or claim relating to the Services within 7 days of the relevant Service. The Company will investigate the complaint and may request reasonable evidence, such as photographs or receipts. Failure to notify the Company within this period may affect the Company’s ability to investigate and may impact any remedy offered.

12. Insurance

The Company will maintain appropriate public liability insurance and, where applicable, employers’ liability insurance in line with industry standards for waste collection and clearance services. Details of current insurance cover can be provided on request.

13. Data Protection and Privacy

The Company may collect and process personal data about the Customer in order to manage bookings, process payments, issue invoices and comply with legal obligations. This may include names, contact details, property addresses and payment information.

The Company will handle personal data in accordance with applicable UK data protection laws. Customer information will only be shared with third parties where necessary to provide the Services, to process payments, to comply with legal requirements, or with the Customer’s explicit consent.

14. Complaints and Disputes

The Company aims to provide a professional waste clearance service and to address any issues promptly. If the Customer is dissatisfied with any aspect of the Service, they should contact the Company as soon as possible with full details of the problem.

The Company will review the complaint, investigate where necessary and seek to resolve the matter amicably. If the parties cannot reach an agreement, either party may pursue any legal remedies available under UK law.

15. Changes to these Terms

The Company may update or amend these Terms and Conditions from time to time. Any changes will take effect when published or when otherwise communicated to the Customer. The version of the Terms and Conditions that applies to a particular Service will be the version in force at the time the booking was confirmed.

16. Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be treated as deleted, but this shall not affect the validity and enforceability of the remaining provisions.

17. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
